Disclaimer & Liability Waiver – Chico Haunted Tours
Chico Haunted Tours (“Company,” “we,” “our,” or “us”) provides walking tours and related services for entertainment and educational purposes. By purchasing a ticket or participating in any tour, you (“Participant”) acknowledge and agree to the following:
1. Nature of the Experience
Our tours feature stories of local history, folklore, and reported hauntings. While we strive for accuracy, some content is based on oral tradition and legend and may include unverified or fictional elements. The tours are intended for entertainment and general information only.
2. Assumption of Risk
California Civil Code §1714 places a duty on individuals to exercise ordinary care for their own safety. You understand and voluntarily accept the inherent risks of a walking tour, including but not limited to: uneven pavement, poor lighting, traffic, sudden noises, or weather conditions. You agree to exercise reasonable care and to follow all instructions from tour guides.
3. Release of Liability
To the fullest extent permitted by California law, you release and discharge Chico Haunted Tours, its owners, employees, independent contractors, volunteers, and affiliates from any and all claims for injury, property damage, loss, or death arising from participation in the tour, whether caused by negligence or otherwise, except to the extent caused by gross negligence or willful misconduct.
4. Medical & Emotional Considerations
The subject matter may be spooky or unsettling. If you have heart conditions, anxiety disorders, or other health concerns, please consult a medical professional before attending. Participation is at your own discretion.
5. Children & Minors
Children under 12 must be accompanied by a parent or legal guardian, who assumes all responsibility for the child’s participation and behavior.
6. Weather & Schedule
Tours operate rain or shine unless conditions present a safety hazard. We reserve the right to modify routes, reschedule, or cancel at our discretion. If a tour is canceled by us, a refund or rebooking will be offered as our sole obligation.
7. Personal Property
You are responsible for your personal belongings. The Company is not liable for loss, theft, or damage to any personal property.
8. Governing Law
This agreement is governed by the laws of the State of California. Any disputes shall be brought in the appropriate court in Butte County, California.
By purchasing a ticket or joining the tour, you acknowledge that you have read and understood this Disclaimer & Liability Waiver and agree to be bound by its terms.
